These Terms of Service (“Terms”) govern your access to and use of our website, skyknights.com (the “Site”), our products, services, and content. By using the Site or purchasing products, you agree to be bound by these Terms. If you do not agree, you may not use the Site or our services.

SkyKnights LLC is dedicated to creating engaging trading card games, digital content, and accessories for our community of players and collectors. These Terms outline the rules and responsibilities for using our Site, purchasing our products, and participating in our community.

2. Eligibility and Account Registration

3. Purchases and PaymentEligibility

• Orders are subject to acceptance and availability.

• We reserve the right to cancel or modify orders, including for pricing errors, suspected fraud, or inventory shortages.

Payment

• Payments must be made using approved methods displayed at checkout (e.g., credit card, PayPal).

• By providing payment information, you confirm that you have the legal right to use the payment method.

Taxes and Duties

You are responsible for any applicable taxes, duties, or customs fees. These will be calculated during checkout where required.

Cancellations

4. Shipping and Delivery

Shipping

• Orders are processed within 2-5 business days, excluding weekends and holidays.

• Shipping times vary based on your location and the selected shipping method.

Delays

SkyKnights is not responsible for shipping delays caused by:

• Carriers, weather, or customs inspections.

• Incorrect or incomplete shipping addresses provided at checkout.

Risk of Loss

All items are shipped FOB Origin (Free on Board). This means risk of loss passes to you once the carrier takes possession of the package.


5. Returns, Refunds, and Exchanges

Returns

Unopened items may be returned within 30 days of delivery for a full refund.

• Opened items, digital downloads, and limited-edition products are non-refundable unless defective.

Refunds

• Refunds are issued within 10 business days after we receive and inspect the returned items.

• Shipping fees are non-refundable.

Defective Products

If your product is defective, contact us at contact@skyknights.co with proof of purchase and photos of the defect.


6. Intellectual Property

All content provided by SkyKnights, including but not limited to:

• Card designs, artwork, and game mechanics.

• Logos, trademarks, and branding.

• Digital and physical products.

Is the exclusive property of SkyKnights LLC or its licensors and is protected under applicable copyright, trademark, and intellectual property laws. Unauthorized use is strictly prohibited.

You may not:

• Reproduce, modify, distribute, or create derivative works based on our content.

• Use our trademarks without explicit written permission.

Fan-created content (e.g., fan art, custom card ideas) is encouraged but must comply with our Fan Content Policy, available on the Site.


7. Community and User Conduct

Code of Conduct

By using our Site, forums, or social platforms, you agree to:

• Treat other users with respect.

• Avoid harassment, hate speech, or discriminatory behavior.

• Refrain from posting offensive, illegal, or infringing content.

We reserve the right to moderate or suspend access for violations of this code.


8. Digital Content

License to Use

For digital downloads (e.g., rulebooks, strategy guides):

• SkyKnights grants you a non-exclusive, non-transferable license to download and use the content for personal, non-commercial purposes.

Restrictions

You may not:

• Share, resell, or distribute digital content.

• Use digital content in ways that infringe on SkyKnights’ intellectual property rights.


9. Privacy and Data Collection

SkyKnights values your privacy. Our use of your personal data is governed by our Privacy Policy, which complies with the California Consumer Privacy Act (CCPA).

Your Rights:

Right to Know: Request details about the personal information we collect.

Right to Delete: Request deletion of your personal data, subject to legal exceptions.

Right to Opt-Out: Opt out of the sale of personal data (SkyKnights does not sell personal data).

10. Warranty Disclaimer

SkyKnights provides all products and services “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to:

• Fitness for a particular purpose.

• Non-infringement.

We do not guarantee uninterrupted access to the Site or that our products will meet your expectations.


11. Limitation of Liability

To the maximum extent permitted by law, SkyKnights is not liable for:

• Indirect, incidental, or consequential damages.

• Loss of data, revenue, or goodwill.

Our total liability is limited to the amount you paid for the affected product or service.


12. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, excluding its conflict of laws principles.

Dispute Resolution

• Disputes will be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

• You waive the right to participate in class-action lawsuits.


13. Pre-Orders

SkyKnights may offer customers the ability to pre-order upcoming products, including trading card game decks, accessories, and limited-edition items. By placing a pre-order, you acknowledge and agree to the following terms:

13.1. Nature of Pre-Orders

• A pre-order is a reservation for a product that has not yet been released or is still in production.

• Estimated release and shipping dates provided at the time of pre-order are approximate and subject to change.

• SkyKnights does not guarantee specific delivery dates for pre-order items.

13.2. Payment for Pre-Orders

• Full payment is typically required at the time of placing a pre-order unless otherwise stated.

• By submitting payment, you agree to these Terms and the specific conditions of the pre-order item.

13.3. Cancellations by Customer

• Pre-orders may be canceled for a full refund prior to the start of order fulfillment (i.e., before the product has been processed for shipping).

• To cancel a pre-order, contact support@skyknights.com with your order number.

13.4. Cancellations by SkyKnights

SkyKnights reserves the right to cancel pre-orders in the following cases:

Production Delays or Issues: If a product cannot be produced or delivered as intended.

Pricing Errors: If there was an error in the listed price or description of the pre-order item.

Suspected Fraud: If the pre-order is flagged for suspicious or fraudulent activity.

In these cases, SkyKnights will issue a full refund to the original payment method.

13.5. Refunds and Returns for Pre-Orders

• Pre-order items follow the same return policy as other products (refer to Section 5).

• Opened or used pre-order items are non-refundable unless defective.

13.6. Shipping of Pre-Orders

• Pre-order items will ship as soon as they are available, in the order in which the pre-orders were received.

• If a pre-order item is combined with other in-stock items in a single order, we may delay the shipment of the entire order until the pre-order item is ready.

13.7. Limited Quantities

Pre-order products may have limited availability, and SkyKnights reserves the right to enforce limits on the quantity of items each customer can pre-order.

13.8. Updates and Notifications

• SkyKnights will provide updates regarding significant changes to the estimated release date or availability of pre-order items.

• Notifications will be sent to the email address associated with your account or pre-order.

13.9. Special Terms for Limited Editions

• Pre-orders for limited-edition items are final and non-refundable once production begins unless the item is defective or canceled by SkyKnights.

• Availability is not guaranteed, and overselling due to system errors may result in cancellations.


14. Updates to Terms

SkyKnights reserves the right to modify these Terms at any time. Changes will be posted on this page, with the effective date updated. Continued use of the Site constitutes acceptance of revised Terms.
